Introduction

International Alert, under the AtJ project and in collaboration with the Ministry of Justice, seeks to strengthen the Alternative Dispute Resolution (ADR) ecosystem in Rwanda. This mapping aims to map and profile ADR service providers across the country as part of efforts to support Rwanda’s Vision 2050 and the National Strategy for Transformation (NST2). Rwanda’s approach to ADR reflects its commitment to expanding access to justice, promoting community cohesion, and fostering a culture of peaceful conflict resolution.

The consultancy will contribute to the effective implementation of ADR policies by generating data to improve the accessibility, availability, and quality of ADR services for Rwandans, further advancing legal empowerment and peacebuilding initiatives.

Context and rationale

Since 2022, Rwanda's Justice, Reconciliation, Law, and Order Sector has embarked on significant reforms aimed at enhancing access to justice, improving the efficiency of the criminal justice system, and upholding the rule of law. These reforms have spanned various aspects of the justice sector, including legal and institutional frameworks, the adoption of innovative technologies, and the implementation of alternative dispute resolution (ADR) mechanisms. By prioritizing transparency, accountability, and the protection of fundamental rights, Rwanda is committed to fostering a fair, responsive judicial system that serves its citizens' needs while promoting societal harmony and sustainable development.

The Rwandan justice sector continues to evolve, driven by strategic reforms designed to improve both the accessibility and efficiency of justice delivery. As the ADR policy gains traction, understanding the full scope of ADR service providers—along with their qualifications, services, costs, and accessibility—is essential to creating a more inclusive and equitable justice system. This mapping will promote transparency, identify gaps in service provision, and support the effective delivery of ADR services, reinforcing Rwanda’s commitment to upholding the rule of law.

The mapping and profiling of ADR stakeholders are integral to the Access to Justice project, which aims to enhance the accessibility, efficiency, and effectiveness of dispute resolution in Rwanda. By identifying and documenting all ADR service providers, the project ensures that citizens have clear and transparent access to a variety of dispute resolution options, contributing to a more inclusive and equitable justice system. This mapping process is pivotal for the successful implementation of Rwanda’s ADR policy, as it will create a comprehensive directory of ADR resources, making it easier for individuals to find the services they need. Moreover, this activity supports the sustainability of the Access to Justice project by building a well-organized ADR ecosystem capable of operating independently and continuously beyond the project’s lifespan. It also aligns with Rwanda’s broader vision of promoting the rule of law, improving the efficiency of the justice sector, and fostering community cohesion—key elements of the country’s long-term development goals.

Consultancy objectives

The primary objectives of the consultancy are:

  1. To identify and map all ADR service providers across Rwanda, covering both local and international providers.
  2. To profile each ADR service provider, including detailed information about their services, qualifications, and accessibility.
  3. To assess the specialization and expertise of each ADR provider, including their areas of focus (family, commercial, international disputes, etc.).
  4. To evaluate the operational transparency and costs of ADR services.
  5. To analyze the accessibility of ADR services (physical and online platforms).
  6. To enhance collaboration of ADR services providers with other stakeholders.
  7. Community will be referred to seek ADR services to the identified actors.

Material and spatial boundaries of the service

The mapping and profiling will cover ADR service providers across the entire territory of Rwanda. This will involve researching both international and local ADR providers, assessing their operational footprint, services, and their ability to cater to diverse communities.

Expected results

  • A comprehensive database of ADR service providers: This database will include essential contact information (name, location, contact details, website, and headquarter address), as well as specific areas of specialization (e.g., family, commercial, and international disputes). It will also provide qualifications, including credentials, experience, and certifications of ADR practitioners.
  • Detailed profiles for each ADR service provider: Each service provider will have an in-depth profile outlining their services (e.g., mediation, arbitration), associated costs, accessibility options, and geographical reach to ensure that users can find relevant information easily.
  • Assessment report on the ADR ecosystem: A detailed report will identify both strengths and gaps within Rwanda’s ADR sector, offering insights into areas that require improvement or expansion.
  • Increased awareness of ADR options: Efforts will be made to raise awareness about available ADR options among key stakeholders, including citizens, justice institutions, and policymakers, to ensure broader understanding and adoption.
  • Enhanced transparency and accountability: The initiative will focus on fostering greater transparency and accountability within the ADR sector to build public trust and ensure high standards of service delivery.
  • Accessibility of ADR services: A focus on ensuring that ADR services are easily accessible both physically and online, including the availability of virtual platforms for ADR processes, making them more flexible and inclusive.
  • Incorporation of other relevant variables: Additional factors and considerations will also be addressed as the project evolves, adapting to emerging needs and challenges within the ADR ecosystem.

Duration of the consultancy

The consultancy is expected to last for 3 months, beginning from the signing of the contract. The key deliverables, including inception reports, drafts, and final reports, will follow the outlined schedule.

Education

The team leader must hold a PhD or master’s degree in law, public policy, economics, or a related field, with significant experience in scientific research. Additional team members should have degrees in statistics, data science, and law, with a demonstrated capacity for research and data analysis.

Experience

  • The consultant should demonstrate proven experience in legal research and in mapping or profiling ADR service providers.
  • Experience in Rwanda’s justice system is highly desirable. The team should also have a record of conducting research on ADR and related fields, with a focus on data collection, analysis, and reporting.
  • Experience with structured survey methods, quantitative and qualitative research (knowledge of some PRA tools, focus groups, interviews, etc.).
  • Proven experience in the field of surveys, preferably within an international organisation or a research firm using new digital data collection technologies.
  • Perfect command of IT tools and good analytical and writing skills.
  • Excellent practice of French, and local languages.
  • Have excellent writing and synthesis skills.
  • Have communication skills with good teamwork skills.

The detailed proposal with the following elements: a technical proposal adapted to the methodology designed and timeline, and a financial proposal for the accomplishment of the aforementioned deliverables. Note that technical and financial proposals must be combined into a single PDF document.

  • Curriculum Vitae of the lead consultant (maximum 5 pages)
  • The copy of the two reports of an activity carried out within the framework of a previous more or less similar project.
  • Three (3) references from organizations (preferably international) for which the independent consultant or his firm has recently (in the last three years) carried out similar services within the framework of projects or programs financed by international organizations/ donors in the area of access to justice.
